The Legal Counsel role can be conducted from Melbourne, Sydney or Brisbane.

The Legal Counsel provides a wide range of legal services to McMillan Shakespeare Limited and its related bodies.

In your Legal Counsel role you will be responsible for supporting and contributing to the growth and success of McMillan Shakespeare’s operations by providing high quality, relevant, commercial and timely legal advice and services that meet business requirement and assist business units to achieve their corporate objectives in a way that complied with relevant legislation, as well as proactively advising the business of its regulatory and legislative requirements.

The Role:

Commercial agreements

  • Negotiating and drafting a wide range of client, supplier, lessor and JV agreements and the provision of quality commercial advice in the terms of those agreements
  • Reviewing, providing advice and preparing responses to tender/customer requests issued by large corporations and State/Commonwealth Governments
  • Providing legal sign-off on agreements and other documents for reliance by company officers when executing such documents.

Marketing Advice

  • Advise on all marketing related obligations including financial services, privacy, Do Not Call Register, SPAM, the Australian Consumer Laws and Trade Promotions
  • Provide legal sign off on advertising and other printed material for dissemination inside and outside the Group, including comfort that no financial product, financial taxation or legal advice has been provided, and advice on Australian competition and consumer issues

Risk Management

  • Providing pro-active advice on legislative and regulatory
  • Intellectual Property
  • Assist in managing the intellectual property portfolio for the MMS Group including applications and disputes in relation to trademarks

Litigation and dispute management

  • Assist in managing litigation and brief external lawyers in a cost-effective manner where litigation has been commenced against the Group to obtain the best possible outcome

Project Work

  • Assist the Group to achieve its objectives through provision of legal support on strategically important projects

Exclusion of tax

  • The responsibilities above exclude advice and management of taxation related issues.

You will bring:

  • Experience in managing a diverse workload and managing competing priorities
  • Self-sufficient in office administration, particularly in the use of Microsoft Office and Outlook
  • Large law firm experience and/or demonstrated in house experience
  • Tertiary qualification in law; and
  • Admitted as a solicitor in Victoria
